Edmunds.com: Gas Guzzler Trade-In Calculator (sometimes spelled Edmonds.com)

Gas_guzzlerOne of my favorite websites, www.edmonds.com, has added a Gas Guzzler Trade-In Calculator to its already rich car value related website!   Here's the Edmonds blurb:  "You would like to save money on gas so you're considering trading in your gas guzzler for a more fuel efficient car. This calculator shows how long will it take before you pay off the balance of a vehicle purchase and really begin saving money."  Here's how it works: "Select the new or used fuel-efficient vehicle you would like to purchase. Edmond's will provide the True Market Value® price and MPG for the vehicle you select. Manufacturer incentives are not included."

Incidentally, Edmonds is the site that I use when advising clients as to whether they are getting a fair offer (is "fair offer" an oxymoron?) from the insurance company on their total loss as they provide you with the fair market value of your vehicle based on condition, options, mileage and location.  They call this great feature the Used Car Appraiser and to use it, click here.

Smart Car: How Safe Is It? Miles Per Gallon?

Smartrear Have you been noticing the proliferation of the Daimler AG's Smart Car recently?  Sure, it gets great mileage, looks pretty cute and zips right along.  But its recent emergence on the scene got me to wondering just how safe this little tiny car would be in a big crash.  According to greencar.com, "The Insurance Institute for Highway Safety (IIHS) recently crash tested the 2008 smart fortwo and found it performed so well it earned the Institute’s best ratings for front and side crash protection. Plus, its rear crash worthiness was rated as “acceptable,” the Institute’s second-highest rating."  Read the complete IIHS report here.

Most interesting to me is the Smart Car Crash Video below.  Crashing into a solid concrete barrier at 70 mph does not completely destroy the car (although it would likely completely destroy its occupants so DON'T TRY THIS AT HOME!).  Watch the chilling yet informative video below:"

And what kind of mileage does the Smart Car get?  According to The Daily Green.com, it gets 33 city and 41 highway.  Did you know that there's also a waiting list of 45,000?  When completely tricked out, this car still runs a little under $20,000 (and the base model starts at around $12,000).

But, folks, I represent people who are injured -- and oftentimes injured in car accidents.  My primary focus is in keeping my clients safe so I'm hesitant to support this car because, in spite of its high ratings, it's still a dinky little car and, at least in Los Angeles, we have a plethora of gigantic cars on the road.  I don't want to get a phone call from you or, worse, a loved one telling me that you've been involved in a Smart Car crash. To me the car is tantamount to a motorcycle with a steel shell.

Smartcrashaction    Is 33/41 mpg worth the risk? Maybe not.

July 4, 1776 Independence Day

Hurrah_for_the_usaFireworks, barbecues, beach, friends and family gathering to celebrate Independence Day: The Fourth of July!!!

Here's to a Happy, Healthy and Safe 4th of July!

I'd like to share some 4th of July tidbits with you:

From History.com:

Independence Day in the U.S., is an annual holiday commemorating the formal adoption by the Continental Congress of the Declaration of Independence on July 4, 1776, in Philadelphia. Although the signing of the Declaration was not completed until August, the Fourth of July holiday has been accepted as the official anniversary of U.S. independence and is celebrated in all states and territories of the U.S.

The holiday was first observed in Philadelphia on July 8, 1776, at which time the Declaration of Independence was read aloud, city bells rang, and bands played. It was not declared a legal holiday, however, until 1941. The Fourth is traditionally celebrated publicly with parades and pageants, patriotic speeches, and organized firing of guns and cannons and displays of fireworks; early in the 20th century public concern for a "safe and sane" holiday resulted in restrictions on general use of fireworks. Family picnics and outings are a feature of private Fourth of July celebrations.

Flag Day, June 14, 2008

American_flag_flying Wikipedia tells us that:

In the United States, Flag Day (more formally, National Flag Day) is celebrated on June 14. It commemorates the adoption of the flag of the United States, which happened that day by resolution of the Second Continental Congress in 1777.

In 1916, President Woodrow Wilson issued a proclamation that officially established June 14 as Flag Day; in August 1949, National Flag Day was established by an Act of Congress.

Flag Day is not an official federal holiday, though on June 14, 1937 Pennsylvania became the first (and only) U.S. state to celebrate Flag Day as a state holiday.

Title 36 Sec. 110 of the US Code is the official statute on Flag Day, however it is at the President's discretion to proclaim officially the observance.

The largest Flag Day parade is held annually in Troy, New York. [1]

Framingham, Massachusetts also holds a yearly Flag Day parade, as do many other towns and cities, although in recent years a shrinking turnout has prompted the town to consider eliminating the event.

New Cell Phone Laws for California as of July 1, 2008: Watch the Video and Read the Text

Drivingoncellphoneandeating Well folks, here's the low down on the new California cell phone laws that go into effect on July 1, 2008 taken directly from the DMV Website.  Whatever you do, do NOT drive while holding your cell phone - you need to be using hands free technology.  And please, please don't text while driving.

Watch the DMV Video by Clicking Here

Two new laws dealing with the use of wireless telephones while driving go into effect July 1, 2008. Below is a list of Frequently Asked Questions concerning these new laws.

Q: When do the new wireless telephone laws take effect?
A: The new laws take effect July 1, 2008.

Q: What is the difference between the two laws?
A: The first prohibits all drivers from using a hand held wireless telephone while operating a motor vehicle, (Vehicle Code (VC) §23123). Motorists 18 and over may use a "hands-free device." Drivers under the age of 18 may NOT use a wireless telephone or hands-free device while operating a motor vehicle (VC §23124).

Q: What if I need to use my telephone during an emergency, and I do not have a "hands-free" device?
A: The law allows a driver to use a wireless telephone to make emergency calls to a law enforcement agency, a medical provider, the fire department, or other emergency services agency.

Q: What are the fines(s) if I’m convicted?
A: The base fine for the FIRST offense is $20 and $50 for subsequent convictions. With the addition of penalty assessments, the fines can be more than triple the base fine amount.

Q: Will I receive a point on my driver license if I’m convicted for a violation of the wireless telephone law?
A: No. The violation is a reportable offense, however, DMV will not assign a violation point.

Q: Will the conviction appear on my driving record?
A: Yes, but the violation point will not be added.

Q: Will there be a grace period when motorists will only get a warning?
A: No. The law becomes effective July 1, 2008. Whether a citation is issued is always at the discretion of the officer based upon his or her determination of the most appropriate remedy for the situation.

Q: Are passengers affected by this law?
A: No. This law only applies to the person driving a motor vehicle.

Q: Do these laws apply to out-of-state drivers whose home states do not have such laws?
A: Yes.

Q: Can I be pulled over by a law enforcement officer for using my hand held wireless telephone?
A: Yes. A law enforcement officer can pull you over just for this infraction.

Q: What if my phone has a push-to-talk feature, can I use that?
A: No. The law does provide an exception for those operating a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way radio operated by a “push-to-talk” feature. However, a push-to-talk feature attached to a hands-free ear piece or other hands-free device is acceptable.

Q: What other exceptions are there?
A: Operators of an authorized emergency vehicle during the course of employment are exempt, as are those motorists operating a vehicle on private property.

DRIVERS 18 AND OVER

Drivers 18 and over will be allowed to use a "hands-free" device to talk on their wireless telephone while driving. The following FAQs apply to those motorists 18 and over.

Q: Does the new “hands-free” law prohibit you from dialing a wireless telephone while driving or just talking on it?
A: The new law does not prohibit dialing, but drivers are strongly urged not to dial while driving.

Bluetoothheadsetreview

Q: Will it be legal to use a Bluetooth or other earpiece?
A: Yes, however you cannot have BOTH ears covered.

Q: Does the new "hands-free" law allow you to use the speaker phone function of your wireless telephone while driving?
A: Yes.

Q: Does the new “hands-free” law allow drivers 18 and over to text message while driving?
A: The law does not specifically prohibit that, but an officer can pull over and issue a citation to a driver of any age if, in the officer’s opinion, the driver was distracted and not operating the vehicle safely. Sending text messages while driving is unsafe at any speed and is strongly discouraged.

DRIVERS UNDER 18

Q: Am I allowed to use my wireless telephone "hands-free?"
A: No. Drivers under the age of 18 may not use a wireless telephone, pager, laptop or any other electronic communication or mobile services device to speak or text while driving in any manner, even "hands-free." EXCEPTION: Permitted in emergency situations to call police, fire or medical authorities (VC §23124).

Q: Why is the law stricter for provisional drivers?
A: Statistics show that teen drivers are more likely than older drivers to be involved in crashes because they lack driving experience and tend to take greater risks. Teen drivers are vulnerable to driving distractions such as talking with passengers, eating or drinking, and talking or texting on wireless devices, which increase the chance of getting involved in serious vehicle crashes.

Q: Can my parents give me permission to allow me to use my wireless telephone while driving?
A: No. The only exception is an emergency situation that requires you to call a law enforcement agency, a health care provider, the fire department or other emergency agency entity.

Q: Does the law apply to me if I’m an emancipated minor?
A: Yes. The restriction applies to all licensed drivers who are under the age of 18.

Q: If I have my parent(s) or someone age 25 years or older in the car with me, may I use my wireless telephone while driving?
A: No. You may only use your wireless telephone in an emergency situation.

Q: Will the restriction appear on my provisional license?
A: No.

Q: May I use the hands-free feature while driving if my car has the feature built in?
A: No. The law prohibits anyone under the age of 18 from using any type of wireless device while driving, except in an emergency situation.

Q: Can a law enforcement officer stop me for using my "hands-free" device while driving?
A: For drivers under the age of 18, this is considered a SECONDARY violation meaning that a law enforcement officer may cite you for using a "hands-free" wireless device if you were pulled over for another violation. However, the prohibition against using a hand held wireless device while driving is a PRIMARY violation for which a law enforcement officer can pull you over.

Elisabeth Fritzl: How She Looks Today, Drawing, Photos and What Crimes Josef Fritzl Committed

This Is London Elisabeth_fritzl_facepublished an interesting article, along with photos, of Elisabeth Fritzl then and now and other related photos.  In their article, it is reported that police say that Elisabeth looks more like her 67 year old mother's sister than daughter.  Her teeth are horrifically decayed,   "After an emotional reunion last weekend, both sides of the family apart from Kerstin are all now living in a special, isolated room in a psychiatric unit near their home.

"Doctors are said to have placed a cargo container outside so that Fritzl's captives can retreat there if they feel too traumatised by daylight and the open space.

"Further details of Elisabeth's time in the cellar have also now emerged. She has apparently told police she was so scared of her father that she submitted herself to him entirely.

"'I don't know why it was so, but my father simply chose me for himself,'" she told officers, according to the Independent.

"It is thought Fritzl first began abusing her when she was 11, in the cellar, his car and on country walks."  Read the entire This Is London article here.

What Crimes Did Josef Fritzl Allegedly Commit?

If I were prosecuting this matter, with what crimes would I charge Fritzl for the heinous acts allegedly committed?  Among other things, kidnapping, rape, false imprisonment, assault & battery, incest, gross sexual imposition, sexual offenses in general.

Josef Fritzl, Elisabeth Fritzl: Rape, Death Threats, Incest, Accomplice

Elisabeth_fritzl_color The horrifying story of the unspeakable acts inflicted upon Elisabeth Fritzl and the children fathered by her father, Josef Fritzl, just goes on and on.  The New Zealand Herald reports that he was a "despot" who, in addition to keeping his daughter locked up for 24 years while sexually abusing her and fathering 7 children with her, took great pleasure in humiliating his wife with whom he hadn't had marital relations in years.  "Sepp," as Josef Fritzl was known, would humiliate his wife of 51 years with "crude, dirty jokes" as well as "tell[ing] her off in front of the others."

Sepp would go down to the basement every morning at 9 am to, allegedly, complete technical drawings of machines.  He would sometimes spend the entire night in the dungeon.  Fritzl, a retired electrical engineer, allegedly threatened his captives, his own flesh and blood, with being gassed to death if they disobeyed him.

There is some speculation that he had an accomplice.  View the BBC video news report here.  Read the BBC News Report here.

In a ghoulish twist, he called his wife in 1994 and faked his daughter Elisabeth's voice asking her to look after the baby that she had left on the doorstep.

Investigators reveal more details in this Reuters News Video.

Austrian Man Confesses to 24 Years of Abuse of Daughter

Josef_fritzl The most shocking story I have heard in years, maybe in my entire life!  A 73 year old Austrian man, Josef Fritzl, has confessed to holding his now 42 year old daughter captive in a cement, soundproof basement for the last 24 years.  During that time he fathered 7 children with her, one of whom died at child birth.

According to the BBCElisabeth_fritzl "The woman, Elisabeth (childhood picture to left), disappeared aged 18 on 28 August 1984 when, according to her testimony to police, her father lured her into the cellar, drugging and handcuffing her before locking her up.

She is reported to have been made to write a letter which made it look as if she had run away. "  Read the rest of the story here.

Gas Saving Tips: Video, Links, More

Gas_prices_512_512 It's no secret that gas prices are climbing up, up and away!  So I've done a little research and have found some links and a video with gas saving tips -- the most common sense tip, of course, is slow down!  Yahoo! published a report from Kiplinger which lists 5 gas saving tips:

  • Find the Lowest Gas Prices by searching GasBuddy.com or GasPriceWatch.com by zip code or city and state to get the lowest prices in your area.
  • Target the Best Time of Day to Buy Gas: The best time of day to fill up your tank is before dawn or late at night, when the sun and traffic volume are both down. Stations usually will raise prices during the day, especially for rush hour.
  • Improve Your Car's Gas Mileage: High speeds, quick starts, and squealing stops burn more gas and money. In his own test, Toews found that he could save 15% by driving 62 mph on the open highway rather than 75 mph. Using cruise control can save you even more. Smoother rides, with less pedal pushing, can save up to 37% in fuel economy, according to Edmunds.com. And don't let your car idle because idling uses up a ton of gas!
  • Keep Your Car in Healthy Shape: Toews says that proper maintenance of air filters, spark plugs, and fluid levels is best for your car and wallet.  And maintain proper tire pressure.
  • Get A Gas Rewards Card: Carrying the right credit card can earn you rebates on gas purchases. One of the most popular rewards cards found using our credit card tool is the Citi Dividend Platinum Select MasterCard. Swiping this card at your gas station earns you 5% cash back, as well as 1% on all other purchases.
