    Is that a correct analysis in light of the law? "..difference between its value before the injury and its value after the repairs have been made, plus the reasonable cost of making the repairs."
    Example 2 implies loss of value minus cost of repairs. This would leave the innocent party to suffer the DV loss uncompensated. Hmmm.
    AZ law does not consider cost of repair in determining loss of value damages.

    Hi Gil. Yes, in California this is the law. We just had a hearing on this exact issue and I was inspired to write this blog post based upon the ruling. It may be different (and possibly more equitable) in other states! I'm just glad to know that, at least in some circumstances, my clients are entitled to the diminution in value.
